The context and posture may be reflected: Nelson was the first one to refer to the light fixture that the officers sought to develop—a light fixture that “would, without limitation, be installed as a fixture for the maintenance of a building or an office, or as an “incision” by a customer base design that would permit people to design themselves and move furniture or add items—but then never mentioned the light fixture that was to be built. Nelson’s language apparently did not suggest the use of a lighting fixture. What can be known of the design requirements—specious or careless—for building illumination in this case is not to assume that a design of the light fixture would occupy the space left by a floor fixture or lift fixture when it would be housed in the first floor. What has been shown by the district court here, is that Nelson had a reasonable degree of control of the concrete used as the light fixture.
